Welcome to Jobs Desk. By using our recruitment services, you agree to the following Terms and Conditions, which govern the relationship between Jobs Desk (hereinafter referred to as "the Agency") and its clients and candidates. These terms are subject to change without prior notice, and continued use of our services implies acceptance of any updated terms.
Scope of Services
Jobs Desk acts as an intermediary between employers (clients) and job seekers (candidates) by offering recruitment, staffing, and headhunting services. Our services include sourcing, screening, shortlisting, and recommending candidates for temporary, contract-based, or permanent employment. We do not guarantee employment or job offers to any candidate.
Client Obligations
Clients must provide accurate job descriptions, company information, salary structure, and other relevant details required for effective recruitment. The client agrees to notify Jobs Desk immediately upon selecting a candidate sourced or referred by us. Clients are not permitted to forward candidate profiles shared by Jobs Desk to any third party without prior written consent.
Candidate Obligations
Candidates must provide truthful and accurate information regarding their qualifications, experience, and personal details. Any false declaration may result in termination of the recruitment process or removal from our database. Candidates understand that final hiring decisions rest solely with the client.
Fee Structure and Payment Terms
Jobs Desk charges clients a service fee upon successful placement of a candidate. The exact fee and payment terms will be specified in the service agreement or proposal accepted by the client. All invoices are payable within 15 days from the date of invoice unless otherwise agreed in writing. Any delay in payment may incur additional charges or suspension of services.
Replacement and Refund Policy
If a placed candidate resigns or is terminated for just cause within the agreed guarantee period, Jobs Desk will provide a one-time free replacement at no additional cost. Refunds, if applicable, are processed as per mutual agreement and mentioned in the signed service contract.
Confidentiality
Both parties agree to maintain strict confidentiality of all proprietary, personal, and business information shared during the recruitment process. Jobs Desk will not disclose any candidate or client information to third parties without written consent, except as required by law.
Liability Limitation
Jobs Desk makes reasonable efforts to verify candidates' credentials but shall not be liable for any loss, damage, misconduct, or negligence arising from a candidate's actions post-employment. Clients are advised to conduct their own background and reference checks before onboarding.
Governing Law and Dispute Resolution
These terms shall be governed by the laws of India. Any disputes arising out of or related to these terms will be subject to the exclusive jurisdiction of courts located in Delhi. Efforts will be made to resolve disputes amicably before seeking legal remedies.
Termination of Services
Either party may terminate the engagement with a written notice of 7 days. However, any pending dues or obligations incurred prior to termination must be honored in full.
